Terms of Service

By accessing or using GymRecord (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Timeless Web Services ("GymRecord", "we", "us").

GymRecord is a workout tracking application designed for individual lifters and personal trainers/coaches. Features vary by subscription plan as described on our pricing page.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

• You must be at least 16 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You must provide accurate information when registering and keep it up to date.
• You may not share accounts or create multiple accounts to circumvent plan limitations.

GymRecord offers three plans: Free, Individual (£3.99/month), and Coach (£9.99/month, includes 5 client slots; additional clients at £1.99/month each).

• Subscriptions are billed monthly in advance through Stripe. By subscribing you authorise recurring charges.
• Prices are in GBP and include any applicable VAT unless stated otherwise.
• We reserve the right to change pricing with at least 30 days notice. Continued use after the notice period constitutes acceptance of the new price.
• Payment disputes must be raised within 60 days of the charge.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date.

We do not offer pro-rata refunds for partial billing periods. Exceptions may be made at our discretion for billing errors or extended service outages.

To request a refund, email [email protected] within 14 days of the charge.

The Coach plan allows you to invite clients to the Service. By inviting a client:

• You confirm you have the client's consent to share their data with you within GymRecord.
• Additional client slots are charged at £1.99/month each and billed with your next monthly cycle.
• Removing a client slot takes effect at the next billing date.

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Transmit malicious code, spam, or content that infringes third-party rights.
• Reverse-engineer, decompile, or scrape the Service without written permission.
• Use automated scripts to create accounts or submit forms in a way that circumvents our bot-protection measures.

We may suspend or terminate accounts that violate these terms without prior notice.

You retain ownership of the workout data and content you enter into the Service. By using the Service, you grant us a limited licence to store and process your content solely to provide the Service to you.

We do not use your personal workout data for advertising or sell it to third parties.

All software, design, branding, and content provided by GymRecord (excluding your content) is our intellectual property or that of our licensors. You may not copy, distribute, or create derivative works without our written consent.

The Service is provided "as is" and "as available". We make no warranties, express or implied, regarding fitness for a particular purpose, uninterrupted availability, or error-free operation.

GymRecord does not provide medical or fitness advice. Consult a qualified professional before starting any exercise programme.

To the fullest extent permitted by English law, our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We are not liable for indirect, incidental, or consequential losses, including lost data, lost profits, or injury arising from your use of the Service.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance.
